It’s not enough to just *have* the documents; you need to know *where* they are, *who* has access, and ensure they’re protected from loss or damage. This includes not just the core estate planning documents like wills and trusts, but also important financial records, insurance policies, and even digital assets like online accounts.

We often advise clients to create a ‘master index’—a detailed list of all their estate planning documents, where they’re located, and who has a copy. This index should be kept in a safe but accessible location – not hidden away in a complex safe that no one can open! We also recommend digital backups, but it’s vital to ensure these backups are secure and accessible to your designated representatives. Many clients worry about privacy, which is understandable. Have you encountered any challenges with clients neglecting to properly organize their documents?

Oh, Beatrice, you wouldn’t believe it! We had one client, a lovely woman named Eleanor, who meticulously drafted her will and trust, but then filed everything away in a storage unit without telling anyone where it was. After she passed, her family spent months searching through countless boxes, desperately trying to locate the documents. It was a chaotic and emotionally draining process. It turned out that the storage unit had been accidentally sold at auction! Thankfully, we were able to reconstruct her estate plan based on previous drafts and her family’s recollections, but it was a much more complicated and expensive process than it needed to be.

Then there was Mr. Henderson, a retired marine, who was a very private man. He kept all of his estate planning documents locked in a safe, but he didn’t leave the combination to anyone. When he passed away, his family had to call a locksmith and ultimately break into the safe. Not only did this cause unnecessary damage, but it also created a lot of anxiety and distrust among his heirs. They were convinced he’d hidden something else inside! It’s a classic example of how good intentions can go awry. Clients sometimes think they’re being clever by hiding things, but they often end up creating more problems than they solve.

It’s not always about lost documents, either. Sometimes, the issue is simply a lack of clarity. Clients may use vague language or make assumptions about what their loved ones will understand. We always emphasize the importance of being precise and unambiguous. If you want something done a certain way, make sure it’s clearly stated in your estate planning documents. About Estate Planning Law – Ted Cook

Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
