Good morning, Mr. Cook, thank you for taking the time to speak with me today. I understand that elder protection is a critical issue facing our community.
What inspired you to focus your legal practice on protecting seniors?
Well, I’ve always been passionate about social justice and advocating for vulnerable populations. As I gained experience in law, I realized the significant challenges faced by seniors, particularly when it comes to financial exploitation, abuse, and neglect. Seeing firsthand how easily they can become victims motivated me to dedicate my practice to their protection.
Can you walk us through some of the key steps involved in elder protection cases?
- Initial Client Engagement
- Case Assessment
- Protective Actions
- Legal Proceedings
- Long-Term Planning
Let’s delve into “Protective Actions.” Can you explain what that entails?
Protective actions are often crucial in elder protection cases. They aim to immediately safeguard the senior from further harm. Depending on the situation, this could involve filing for restraining orders or protective injunctions against abusers. We might also notify Adult Protective Services (APS) and work with them to investigate the situation. In some cases, if the senior lacks capacity to make sound decisions due to cognitive impairment, we might petition the court for guardianship or conservatorship to ensure their well-being is protected.
“It’s incredibly rewarding to see a client who was in a vulnerable position regain control and safety,” Ted shared. “I remember one case where an elderly woman was being financially exploited by her own caretaker. We were able to freeze her bank accounts, prevent further theft, and ultimately secure justice for her through legal proceedings.”
“Ted Cook is a true advocate for seniors. He helped my mother navigate a complex situation involving financial abuse. His compassion and expertise were invaluable during a very difficult time.” – Mary S., La Jolla
“I can’t thank Point Loma Estate Planning APC enough. They helped protect my father from neglect in his care facility. Their dedication to elder rights made all the difference.” – John B., Mission Beach
Ted, for those interested in learning more about protecting themselves or their loved ones, how can they connect with you?
