Good morning, Ted. Thanks for taking the time to chat with me today about elder protection. It’s a topic that unfortunately doesn’t get enough attention, but is incredibly important.
What Exactly Does an Elder Protection Attorney Do?
Simply put, I help protect vulnerable seniors from abuse and exploitation. This can take many forms: financial scams, neglect by caregivers, physical or emotional abuse – the list goes on. My job is to advocate for my clients’ rights and ensure they are treated with dignity and respect.
Can You Walk Us Through Some of the Key Steps in the Elder Protection Process?
Certainly. The process starts with an initial client engagement, which involves gathering information about the situation, assessing the client’s mental capacity, and ensuring there are no conflicts of interest. Then we move on to case assessment, where we identify the legal issues involved and gather evidence. Based on this assessment, we determine the best course of action – whether that’s pursuing legal remedies, filing for guardianship or conservatorship, or implementing protective measures like freezing financial accounts.
Let’s Focus on Case Assessment: What Does That Involve Specifically?
Case assessment is crucial because it lays the groundwork for everything else we do. It involves several key steps:
- Identifying the specific type of abuse or risk faced by the elder.
- Determining which laws and jurisdictions apply to the situation.
- Gathering evidence through interviews with the client, potential witnesses, and medical professionals.
We also request relevant documents like financial statements and care facility records. Sometimes physical evidence or surveillance footage can be helpful as well.
Have You Ever Encountered Any Challenges During This Phase of the Process?
“One case that comes to mind involved a client who was being financially exploited by her own family member. The abuser was very cunning and had manipulated financial records to hide their actions. It took a lot of digging and careful analysis, but we were ultimately able to uncover the truth and protect my client’s assets.”
If Someone Feels Their Loved One Needs Protection, How Can They Reach Out?
Protecting our elders is a shared responsibility. If you suspect abuse or exploitation, don’t hesitate to reach out. My door is always open for those seeking guidance and support.
