Hello everyone, and welcome back. Today I have the pleasure of speaking with Ted Cook, an Elder Protection Attorney based right here in beautiful Point Loma. Ted, thanks so much for taking the time to chat with me.
What Inspired You To Focus On Elder Protection?
You know, it wasn’t a single “aha!” moment, but rather a series of experiences. Early on, I saw how vulnerable seniors can be to exploitation and abuse. It saddened me deeply. I realized that my legal skills could be a powerful tool in protecting them and ensuring their safety and well-being.
How Does The Elder Protection Process Typically Begin?
It usually starts with an initial consultation where I get to know the individual, understand their situation, and assess their capacity. We discuss their concerns and goals, and together we determine the best course of action. This could involve anything from mediating family disputes to pursuing legal action against abusers.
Let’s Dive Into A Specific Step: Emergency Legal Remedies
Emergency legal remedies are crucial when a senior is facing immediate danger. It might be financial abuse, physical abuse, or neglect. In these situations, time is of the essence.
We can file for restraining orders to protect them from further harm. We also work closely with Adult Protective Services (APS) and law enforcement to ensure the individual’s safety.
Sometimes, we need to petition the court for guardianship or conservatorship if the senior lacks the capacity to make sound decisions for themselves.
- “Speed is paramount in these cases,” Ted explains. “Every moment counts when someone’s health and well-being are at risk.”
“I recall a case where a senior was being financially exploited by their caregiver. We were able to quickly freeze their bank accounts and prevent further losses. It was incredibly rewarding to see the relief on their face knowing they were finally safe.”
What Challenges Have You Encountered When Implementing Emergency Legal Remedies?
“There have been times when we faced resistance from family members or those perpetrating the abuse. They might try to deny the problem or obstruct our efforts.
It can be emotionally draining, but I never lose sight of my responsibility to protect the vulnerable individual. Patience and persistence are key in these situations.”
“Ted helped me navigate a very difficult situation with my mother. He was compassionate, understanding, and fiercely protective of her rights.” – Margaret S., La Jolla
