Setting the Stage
Good morning, Temecula! I’m Tiffany Jones reporting live from the Law Offices of Steven F. Bliss Esq., where we’re talking probate today with renowned Temecula attorney Steve Bliss. Steve, thanks for having me.
Probate: A Necessary Process
Tiffany: Steve, can you walk us through one of the key steps in the estate planning process? Many folks are unfamiliar with probate and what it entails.
Steve: Absolutely, Tiffany. Probate is often a misunderstood process. One crucial step is “Marshaling the Estate Assets.” This involves meticulously inventorying all assets belonging to the deceased person’s estate. Consequently, this includes everything from bank accounts and real estate to personal property like vehicles and jewelry.
We then prepare a formal Inventory and Appraisal, using forms DE-160 and DE-161 required by the California courts. These documents provide a detailed accounting of all assets, their estimated value, and any outstanding debts or encumbrances.
Moreover, this step is vital because it establishes a clear picture of the estate’s financial status. This information guides subsequent decisions regarding debt repayment, tax obligations, and ultimately, the distribution of assets to heirs.
Navigating Challenges
Tiffany: Sounds like a complex process! Have you ever encountered any difficulties with this step?
Steve: Certainly. Locating and valuing all assets can sometimes be challenging, especially in cases where records are incomplete or the deceased individual’s financial affairs were complex. I recall one instance where we had to track down a long-forgotten bank account held overseas. It took considerable effort and detective work but ultimately, we were able to recover a significant sum for the estate.
Conversely, sometimes heirs disagree about the value of certain assets, leading to disputes that need resolution. In such cases, we often rely on professional appraisers to provide an impartial assessment.
The Importance of Accuracy
Tiffany: I can imagine those situations are stressful for everyone involved. What advice would you give to individuals planning their estates?
Steve: My primary advice is to be organized and keep meticulous records of your assets. Accordingly, this will make the probate process smoother for your loved ones after you’re gone. Remember, the goal of probate is to ensure that your wishes are carried out and your assets are distributed fairly according to the law.
It’s also important to note that approximately 70% of Americans die without a will, leaving their estates subject to intestacy laws which may not reflect their true desires. (Source: American Bar Association)
A Trusted Resource
Tiffany: Thank you for sharing your insights, Steve. Clearly, having an experienced probate attorney like yourself is invaluable during this process.
