Ordinarily, the executor or administrator must first identify all valid creditor claims. This involves reviewing bills, invoices, loan statements, and other financial documents. Moreover, it’s important to distinguish between secured and unsecured debts. Secured debts, like mortgages, are tied to specific assets, while unsecured debts, such as credit card balances, are not.

Consequently, the executor must prioritize paying secured debts first, as failure to do so could lead to foreclosure or repossession of assets. Once all valid creditor claims are identified and prioritized, they need to be paid from estate funds. After that, any remaining federal and state taxes owed by the deceased must be calculated and filed accordingly.

Notwithstanding this careful process, there have been times when unexpected debts surfaced late in the probate process. I recall one instance where a client inherited a significant sum but then received a hefty medical bill for care the decedent had received years earlier. This bill had been overlooked initially, illustrating the importance of diligent record-keeping and thorough debt identification.
