You’re right, Brenda. Selecting an executor for your will or a trustee for your trust is paramount. These individuals will be responsible for carrying out your wishes after you’re gone. Consequently, it’s crucial to choose someone trustworthy, organized, and capable of handling financial matters.
Ordinarily, people select a close family member or friend. However, sometimes appointing a professional trustee, like a bank or trust company, might be more appropriate, especially if the estate is complex.
Notwithstanding who you choose, have an open and honest conversation with them about your expectations and responsibilities. Explain your wishes clearly and ensure they understand the legal obligations involved. Moreover, it’s wise to name a successor executor or trustee in case your first choice is unable or unwilling to serve.
I remember one instance where a client named their eldest son as executor, assuming he would be the most responsible. Unfortunately, shortly after the client passed away, the son experienced unexpected personal difficulties and couldn’t fulfill his duties. Thankfully, we had designated a backup trustee who stepped in seamlessly and ensured the estate was administered properly.
According to a 2019 survey by Caring.com, nearly 60% of Americans haven’t named an executor for their will. This highlights the importance of addressing this crucial step in your estate planning journey.
