What Got You Started in Estate Planning?
Ted: Well, it’s funny you ask that. I didn’t initially set out to be an estate planning attorney. I actually started my legal career focusing on corporate law. However, after working with a few clients who needed help navigating complex family situations and asset distribution after the loss of a loved one, I realized I was truly passionate about helping people protect what matters most.
What is One Key Step in Estate Planning That People Often Overlook?
Ted: I’d say that a lot of people underestimate the importance of “Funding the Trust.” It’s not enough to simply create a trust document. You need to actually transfer ownership of your assets into the trust for it to be effective. This means retitling bank accounts, real estate, and other investments in the name of the trust.
- Think of it like this: a trust is like a container, and your assets are the things you put inside.
- If you don’t put anything into the container, it’s not going to be very useful!
“Funding the Trust” can involve some paperwork and coordination with financial institutions, but it’s a crucial step in ensuring your wishes are carried out.
One client, let’s call him John, came to me thinking he had everything covered because he had a trust document.
But when we looked closer, most of his assets were still held in his individual name. It took some extra effort to get those assets transferred into the trust, but ultimately it provided peace of mind for him and his family knowing that everything was properly structured.
I’ve had a few situations where clients thought they had “funded” their trust correctly, only to discover later that key assets were still outside the trust’s protection. It can lead to unintended consequences and complicate things during probate.
