Certainly. A Revocable Living Trust is a great option for most individuals and families. It allows the grantor – the person setting up the trust – to maintain control over their assets during their lifetime. They can make changes, add or remove beneficiaries, and even dissolve the trust entirely if needed.
Consequently, it offers flexibility that’s important to many people. Upon the grantor’s passing, the trust becomes irrevocable, meaning it cannot be changed. The assets within the trust then pass to the designated beneficiaries according to your wishes, bypassing probate. This can save your loved ones time and expense during a difficult period.
Moreover, a Revocable Living Trust provides privacy. Probate is a public process, while trust administration is generally private. This means your financial affairs remain confidential.
Conversely, it’s important to note that assets held in a revocable living trust are still considered part of your taxable estate. For those concerned about estate taxes, an Irrevocable Trust might be a better option.

Steve, I know probate can be a lengthy and complicated process. Can you elaborate on how a Revocable Living Trust helps avoid that?
Steve Bliss:
Absolutely. When someone passes away without a will or trust in place, their assets go through probate court. This involves filing paperwork, notifying creditors, and potentially going to hearings. It can take months or even years to complete, depending on the complexity of the estate.
A Revocable Living Trust avoids probate entirely because the assets are already owned by the trust, not the individual. Upon death, the successor trustee named in the trust takes over and distributes the assets according to your instructions. This streamlines the process significantly, often allowing beneficiaries to receive their inheritance within weeks or months.
Avoiding probate is especially important if you have minor children as beneficiaries. Through a Revocable Living Trust, you can designate a guardian for your children and ensure that they are cared for according to your wishes.
Ordinarily, with probate, the court would decide guardianship, which may not align with your preferences.

It’s not uncommon for people to hesitate initially. They might be intimidated by the legal process or worry about losing control over their assets. That’s why it’s crucial to have open and honest conversations with clients, explaining the benefits and addressing any concerns they may have.
I remember one couple who came to me incredibly anxious. They had heard horror stories about probate and were determined to avoid it at all costs. They were hesitant to give up control over their assets, even though I assured them that a Revocable Living Trust wouldn’t take away their autonomy.
Once we explained the process thoroughly and addressed their fears, they were relieved and grateful. They realized that setting up a trust was the best way to protect their family and ensure their wishes were carried out. Seeing them gain peace of mind was incredibly rewarding.
